Conclusion

There clearly is some support in China for the argument that commercial sexual activities should be legalized or decriminalized to assist the task of STIs-HIV prevention, give sex worker's legal and social protections, and enable policing authorities to focus on the problems of child prostitution and forced prostitution. However, it is equally clear that there is confusion regarding what the terms ‘legalization’ and ‘decriminalization’ actually mean. Moreover, insofar as the adoption of such policies will require some form of governing or administering the sex industry, there is no consensus as to what such policies would look like, and how they might be put in place and by whom. Adding to these problems, ethnographic research conducted among men and women who provide commercial sexual services suggests that collective organization for improvements in the working conditions of Chinese sex workers is complicated by factors other than social and legal marginalization (Kong 2010a; Zheng 2010a: 55–64, 2009b: 125–7). It is complicated by the intense competition that exists between sex workers to obtain and keep regular clients while they still can and by the fact that they move to different venues and different parts of the country on a regular basis, in order to maximize profits and minimize the effects of internal competition.
